The Labour Court left in place a Rights Commissioner’s recommendation that the Services Industrial Professional Technical Union’s claim against Jetmara Teo fail. The decision was dated 11 January 1991. The union challenged the use of a worker’s tax rebate in calculating sick pay, arguing that the scheme did not provide for it and that it disadvantaged single workers. The company said it had not refunded tax rebates and that doing so could raise sick pay above normal basic pay. The Court found no documentary evidence supporting the union’s claim of a contrary past practice.
