In 2002, the Labour Court dismissed South Eastern Health Board's appeal and affirmed a recommendation that a worker be appointed as a Clinical Nurse Manager 1, with retrospection to November 1999. The Court signed its decision on 13 December 2002. The worker had applied before the closing date, while two nurses who applied five months later were successful. The Board argued the worker lacked sufficient service and should accept compensation instead. The union said the worker had followed the application guidelines and should receive the appointment and retrospection. The Court noted the worker had no input into the decision to lift the closing date and the union had not been consulted. It found the Rights Commissioner's recommendation reasonable and appropriate.
