Labour Court upholds three-month allowance recommendation for Limerick Corporation worker

The Labour Court upheld a recommendation that Limerick Corporation pay a worker the Acting Assistant Supervisor allowance for three additional months after his Community Employment scheme ended. The decision was dated 15 November 2001. The Services Industrial Professional Technical Union argued that the worker had held the acting rate for five years and should not lose pay when he returned to his substantive post. The Corporation said the role was temporary and he knew he would return to that post when the scheme ended. The Court upheld the recommendation, with the qualification that the worker could benefit from any more favourable national arrangements for the termination of local-authority Community Employment schemes. The worker is not named in the decision.
