Labour Court leaves Ann Munoz appeal decision in place after late filing

The Labour Court found Ann Munoz’s appeal out of time and left in place the adjudication officer’s decision that the WRC had no jurisdiction to hear her unfair-dismissal complaint. The Court’s decision is dated 8 August 2024. Munoz’s employment with Awp Health & Life Spa Allianz Partners ended by redundancy on 30 November 2021. She referred her complaint to the WRC on 12 October 2022, outside the six-month statutory limit. The adjudication officer found she had not established reasonable cause for the delay. Her appeal notice reached the Labour Court 43 days after that decision, and her counsel said there were no exceptional circumstances to explain the late filing. The Court said it had no jurisdiction to extend the time limit. The merits of the complaint were not decided.
