Labour Court dismisses Gheorghe Daniel Marcu’s unfair dismissal appeal

The Labour Court dismissed Gheorghe Daniel Marcu’s unfair dismissal appeal against Dangan Group because his complaint was made outside the statutory time limit. The Court affirmed the adjudication officer’s decision. The Court’s decision was dated 24 April 2024. Mr Marcu said his employment ended on 14 April 2020, while the complaint was made to the WRC on 21 May 2022. Dangan Group disputed that a dismissal had occurred and also argued that the complaint was out of time. The Court decided the time-limit issue first. Because the complaint was late, it did not decide whether a dismissal occurred or whether it was unfair; the merits were not decided.
