WRC finds Michael Mc Kenna entitled to statutory redundancy payment

Michael Mc Kenna is entitled to a statutory redundancy payment after Patrick Gilsenan closed the business where he worked as a driver. The Workplace Relations Commission found his complaint well founded in a decision dated 24 April 2024. Mr Mc Kenna worked from October 2010 until July 2023, usually about 13 hours a week. He said he earned €154.46 gross a week and had not received the redundancy payment he sought. Mr Gilsenan agreed with his evidence and said he closed the business because the work had become unsustainable. The WRC found that the closure made Mr Mc Kenna’s job redundant and that he met the statutory service and other eligibility requirements. His entitlement is based on his employment dates and gross weekly pay of €154.46, subject to confirmation that the employment was insurable. The Department of Social Protection will calculate the lump sum.
