Labour Court dismisses appeal over substitution of employer in unfair dismissal case

The Labour Court dismissed William McKeever’s appeal after he asked to replace the company named in his unfair dismissal complaint with his actual employer. The determination was dated 23 August 2023. McKeever had been employed by PFP Fire Systems Ireland Limited, not the named respondent, PFP Ireland High Performance Systems Limited. The Court said its powers came from statute and it had no authority to make the requested substitution. It upheld the Adjudication Officer’s decision to decline jurisdiction, so the merits of the unfair dismissal complaint were not decided.
