The Labour Court has upheld a decision against legal secretary Mrs Carol Connolly in her constructive dismissal appeal against Ryans Solicitors LLP. The determination was dated 3 February 2023. Connolly said a statement of employment terms she received around 4 February 2021, particularly its description of her working hours, prompted her resignation.
The Court said a worker claiming constructive dismissal must raise concerns with the employer and give it a reasonable chance to address them. Connolly did not make a formal grievance about the statement before resigning. The Court found she had not shown that her resignation amounted to constructive dismissal, so her appeal failed and the original decision was upheld.
