Labour Court affirms decision against Microsoft Ireland MSFT in time-limit appeal

The Labour Court affirmed the decision rejecting Ralph Aderko Kodjo.Wayo’s constructive unfair dismissal complaint against Microsoft Ireland MSFT. The Court found the complaint was brought outside the time limit and was not well founded; the merits were not decided. The determination was signed on 20 September 2022. Kodjo.wayo cited health concerns and his wish to complete probation in a new job as reasons for filing late. The Court found no evidence that his health prevented him from filing on time or explained the delay, and said his wish to complete probation did not establish that he could not file within the time limit.
