The Labour Court has upheld a decision rejecting Alan Cameron’s unfair dismissal complaint against Maybin Support Services (Ireland) Limited T/A Momentum Support. The determination was signed on 20 September 2022. Cameron argued that the redundancy appeal process was unfair because the company communicated its decision three days after his dismissal took effect. The company said falling business after the Covid-19 pandemic required lower staffing costs and that the selection process was fair. The Court found that a genuine redundancy situation existed and that Cameron had been selected fairly and objectively. It also found that the delay in communicating the appeal result did not make the procedure unfair. His appeal failed, and the Adjudication Officer’s decision was upheld.
