The Labour Court awarded Patrick Markey €5,750 in compensation for loss of earnings after finding he was unfairly dismissed by Boylesports Unlimited Company. The determination was dated 12 January 2021.

Markey said he was pressured to resign after his manager raised concerns about his on-call payment claims. Boylesports said he had resigned voluntarily rather than face an investigation. The Court found it was not unreasonable for Markey to believe he had been pressured to leave, and that management did not give him a proper opportunity to reverse his resignation and take part in an investigation.

The Court also found Markey had contributed significantly to his dismissal. He gave verbal evidence of efforts to find work but no documents to support those efforts. The award was equivalent to about three months’ gross pay.
