The Labour Court dismissed Bogumil Puka’s appeal against the finding that his unfair dismissal complaint was not well founded. It dated its determination 12 February 2020. Puka, a security officer, said workplace concerns including an injury, pay and hours issues, and difficulty securing a meeting with a senior manager led him to resign. Ocs One Complete Solution Ltd said he resigned voluntarily and had not used its grievance procedure. The Court found he had not given the employer an opportunity to address his concerns before resigning, and that the employer’s conduct did not justify constructive dismissal.
