The Labour Court rejected Brendan Tynan’s appeal and affirmed the decision that his unfair-dismissal complaint was not well founded. The determination was dated 1 October 2018. Tynan said he had a verbal commitment that he could work beyond his agreed retirement date if he remained in good health. Tradewins Ireland Limited T/A Expd8 Ireland denied making that commitment and relied on his contract, which set his retirement date as 22 August 2016. The Court said the contract could not reasonably be read as allowing Tynan to choose a different retirement date, and rejected his appeal.
