The Labour Court set aside the decision against David Byrne and found that Meath County Council should have continued paying his acting allowance during the period in dispute. The determination was signed on 1 October 2018.
Byrne said he continued doing the same higher-level work after the allowance stopped; the Council said he had returned to his substantive grade. The Court found there had been no assessment of his duties and that the Council could not establish that the post had been properly suppressed. It found the allowance remained payable from 6 June to 4 October 2017.
