The Labour Court overturned a €35,840 award to Tony Breslin after upholding Trinity Motors Wicklow Limited’s appeal. In a decision dated 2 October 2024, the Court found the employer had not breached the rules protecting workers’ terms and conditions when a business changes hands.
Breslin said his job title, duties, hours and leave arrangements changed after his transfer from his previous employer. The Court found he continued his core work as a sales manager and managing staff, and that the changes to finance and vehicle valuation tasks did not reduce his contractual rights. It also found that his hours were the only measurable change and that he had voluntarily accepted them.
