Labour Court rejects Seamus Hayes appeal over late transfer complaint

The Labour Court dismissed Seamus Hayes’s appeal against Eir after finding his transfer regulations complaint was made outside the statutory time limit. The determination was signed on 27 September 2023. Hayes said a contract issued by Eir and signed by him in October 2019 breached the regulations. He complained to the Workplace Relations Commission in December 2021, more than two years later. The law generally requires a complaint within six months of an alleged breach, with an extension possible in some circumstances up to a maximum of twelve months. The Labour Court affirmed the adjudicator’s decision. The merits were not decided.
