The Labour Court dismissed Liam Neville’s appeal against Fastnet Films T/A Muddy Pictures DAC after finding that both sides agreed no transfer had occurred. In a determination dated 15 October 2018, the Court varied the Adjudication Officer’s decision. Neville, represented by GMB Trade Union, said he worked as a driver on one production and was not offered work on a later production. The company, represented by Peninsula Business Services (Ireland) Limited, argued the transfer rules did not apply. The Court found the appeal failed because no transfer within the Regulations had taken place.
