The Labour Court upheld an Adjudication Officer’s decision that Larry O' Connor’s complaint about his application to retire on health grounds fell outside the scope of the Terms of Employment (Information) Acts. The complaint failed, and the determination was dated 30 October 2018. O' Connor accepted at the hearing that his complaint did not fall within the relevant sections of the Acts. The Health Service Executive (Cork and Kerry) also argued that the claim was outside the Acts’ scope, and the Court agreed.
