The Labour Court declared Pawel Sowinski entitled to a statutory redundancy lump sum after finding reasonable cause for his late claim. In a determination dated 16 March 2023, the Court varied an adjudication officer’s decision. Sowinski’s employer, Serdang Limited T/A Blarney Hotel & Golf Resort, had appealed, arguing that the claim was out of time. Sowinski said he had not received notice of his redundancy and did not know when it took effect until the WRC hearing. The Court accepted that he learned of the redundancy only some time after it happened and found reasonable cause for filing about five weeks beyond the 52-week deadline. Both parties accepted that his employment ended by redundancy on 17 April 2020. The Court declared him entitled to the statutory lump sum calculated under the Act. The decision gives no amount for that lump sum; the €80.80 it mentions was gross pay in lieu of untaken holidays.
