The Labour Court disallowed Gerard Daniel’s appeal and upheld the decision that his statutory redundancy complaint was out of time. The Court signed its determination on 10 November 2020. The merits were not decided: the Court refused to extend the time limit and did not consider the substantive claim. Daniel said he waited for a Department of Employment Affairs and Social Protection decision on his employment status before making his WRC claim. Dublin Enterprise & Technology Centre argued that he had never been its employee and that the claim missed the 52-week deadline. The Court said the social welfare decision did not determine his separate employment-law claim, and that ignorance of legal entitlements did not excuse the delay.
