The Labour Court rejected Kieran Mcnulty’s appeal over his claim of a €214.80 wage shortfall after Theo Benning Ireland Gmbh reduced his hours in November 2022. The Court signed its determination on 31 March 2025. McNulty argued that his contract did not allow compulsory reductions and that he had not consented. The employer said short-time working was an established practice. The Court found he had worked reduced hours in nine of 14 years and that the practice had become an implied contract term authorising the reductions. It upheld the finding that his complaint under the Payment of Wages Act 1991 was not well founded.
