The Labour Court upheld the Adjudication Officer’s decision on Kelvin Gopaul’s appeal against Fallon and Byrne over an alleged wages deduction. The Court’s decision was dated 5 January 2024. Gopaul said the alleged breaches occurred during the Temporary Wage Subsidy Scheme in July 2021. The Court found he lodged his complaint outside the statutory time limit and had acknowledged that no alleged contravention occurred within the relevant period. It had no jurisdiction to hear the claim, so the merits were not decided.
