The Labour Court allowed Tridium Ltd’s appeal and set aside an €11,500 net award to former employee Ken O’Toole in a Payment of Wages Act case. The decision was dated 12 December 2023. O’Toole claimed €20,250 in wages for October 2020 to February 2021, saying he had not agreed to work without pay. The Court found no credible evidence that the claimed wages, or any other amount, fell due on 31 July 2021. It also said his account lacked credibility and was unsupported by documents. The Court found he had failed to support his claim with credible evidence, and Tridium’s appeal succeeded.
