Labour Court rejects Alan Mcandrew’s appeal over DHL wage reduction

The Labour Court found that DHL Supply Chain (Ireland) Limited did not make unlawful wage deductions when it stopped paying Alan Mcandrew a 20% night-shift premium. Its determination is dated 14 November 2023. McAndrew argued that the reduction in his wages was unlawful. The Court found that his contractual rate included an industry-standard 20% premium and that it was no longer properly payable because he had not worked night shifts for more than a year, with no reasonable prospect of returning to them. His appeal failed, and the Court varied the Adjudication Officer’s decision without specifying the terms of the variation.
