Labour Court affirms wage complaint decision after employer’s appeal fails

The Labour Court has affirmed a decision that the Alteration Centre unlawfully deducted wages by not paying Ms Marzena Ramza-Swietoslawska for her notice period. The determination was signed on 10 December 2021. The employer argued that an email sent on 15 March 2019 counted as an appeal, but the completed appeal form reached the Court on 20 March, after the 18 March deadline. The Court found the email did not meet the requirements for an appeal. With no application to extend the deadline, the appeal failed and the Adjudication Officer’s decision was affirmed.
