Labour Court upholds rejection of Barry Connell’s overtime complaint

The Labour Court upheld the decision rejecting Mr Barry Connell’s overtime pay complaint against Lake Region Medical Limited. The determination was dated 4 November 2021. Connell argued that six Saturday night shifts should have attracted time-and-a-half for the first four hours and double time thereafter. The company said Saturday shifts formed part of his four-cycle roster, averaging 42 hours a week over an eight-week cycle, and that he received time-and-a-half for hours above 39 a week. Connell acknowledged that Saturday work was part of his normal roster and that no further overtime payment was payable. The Court found no wages were properly payable in the relevant period, so the appeal failed.
