The Labour Court upheld the Adjudication Officer’s decision after Conar Kennedy did not attend the hearing to move his appeal. The merits of the appeal were not decided. The determination was signed on 12 August 2019.
Kennedy had appealed decisions on complaints against the Department of Business, Enterprise and Innovation under the Payment of Wages Act, 1991. The Adjudication Officer had found the complaints not well founded. The Court said an appellant cannot move an appeal in their absence.
