The Labour Court recommended that Architectural Aluminium Ltd pay Moya Sweeney €7,000 after finding she was treated unfairly when dismissed during probation. The recommendation was dated 13 August 2019. Sweeney said she was dismissed at a meeting without advance notice of its purpose, a chance to respond to concerns or an opportunity to have representation. The Court found the employer had not followed the Code of Practice on Grievance and Disciplinary Procedures. A performance review had raised concerns, but a further review did not take place, and the dismissal decision had already been made before the November meeting. The Court said employers must act fairly during probation. Sweeney had a right to appeal her dismissal but did not use it. The €7,000 was recommended as compensation in full and final settlement of her claim.
