The Labour Court has upheld the rejection of Rachel McKenna’s complaint that the Department Of Education And Skills unlawfully deducted wages by refusing incremental credit for her teaching in Switzerland. The determination was dated 28 May 2019. McKenna argued that two years teaching at a private school in Switzerland should count as approved service. The Department said the applicable circulars allowed it to decide whether teaching outside the EU qualified. The Court found that the circular gave the Department that discretion, which it had exercised, and that the claimed credit was not wages properly payable to McKenna. Her appeal failed.
