The WRC found an administrator’s unfair dismissal complaint against an employment agency was not well founded. In a decision dated 29 May 2019, it found her 6 November 2017 email showed she intended to end the employment relationship. The administrator said the agency’s failure to secure her return to a role with a distribution company amounted to constructive dismissal. The agency argued that an earlier email was her resignation and that the complaint was out of time. The WRC found that not guaranteeing her return to a particular role did not repudiate her contract or give her reasonable grounds to consider herself dismissed.
