The Labour Court affirmed the rejection of Tomasz Kordecki’s complaint that Tesco Ireland Limited unlawfully withheld his team leader allowance. The Court’s determination was dated 29 November 2016. Kordecki argued that his demotion and the loss of the allowance breached his contract, and that Tesco’s first letter about the disciplinary outcome did not mention the demotion. Tesco said he had refused a manager’s instruction and that the first letter omitted the demotion in error. The Court found Kordecki had been offered an internal appeal but did not use it. It concluded the allowance was not properly payable after he ceased to hold the team leader grade and perform that work, and found the complaint not well founded.
