The Workplace Relations Commission awarded a specialist pharmacist €14,159 for underpaid public holiday and maternity pay. Adjudication Officer Kevin Baneham dated the decision 30 November 2016.
The public health provider accepted that public holiday pay had been miscalculated and undertook to pay what was due. The adjudicator awarded €2,549 for the public holiday shortfall. On maternity pay, the provider argued that the pharmacist’s pay was correctly based on a 37-hour week. Baneham found that her pay during two earlier maternity leaves had been calculated using hours worked before leave, and that there was no statutory or contractual basis for changing that approach. He upheld the maternity-pay claim and found €11,610 was owed. The total award was €14,159.
