The Labour Court rejected Sally Stone’s appeal against a finding that her penalisation complaint against Allied Irish Bank PLC was not well founded. The determination was dated 13 December 2013. The Court also recorded that Stone withdrew a separate complaint about being refused participation in the bank’s voluntary early retirement scheme.

Stone said the bank penalised her in connection with her personalised-hours contract and the handling of her grievance. Her application to extend the contract was made after the scheme’s six-month deadline. The Court found the bank was not required under the scheme to consider a late application within a set time or at all. Stone did not dispute that the bank could end the contract and require her to return to full-time work.

The Court found that Stone had not identified a protected act or a disadvantage she suffered as a result. It found the complaint was not well founded and did not allow the appeal. The withdrawn early-retirement complaint was not decided on its merits.
