The Labour Court dismissed Roisin Curry’s appeal and upheld a Rights Commissioner’s finding that Boxmore Plastics Limited had not breached the part-time work law. The determination was dated 19 December 2003. Curry, represented by the Services Industrial Professional Technical Union, was a part-time worker. The union argued that weekend workers asked to work weekdays should receive overtime for hours beyond their contracted hours. Boxmore said overtime was paid only after 40 hours in a week. The Court found the union had not provided evidence that full-time workers received overtime before completing 40 hours, and accepted that Boxmore did not pay such overtime in practice. It concluded that requiring part-time workers to reach the same hours threshold as comparable full-time workers was not unfavourable treatment under the Act.
