The Labour Court ordered Komfort Kare to pay Dean Hart €2,500 compensation after finding he was entitled to force majeure leave on 22 and 23 May 2024. The determination, signed on 8 January 2025, varied an earlier decision that had awarded €7,000.
Hart sought leave for those two days after an emergency involving his wife; the company had granted leave for 21 May but denied his further request. Hart said his presence remained necessary, while Komfort Kare argued the urgent need had ended and alternative leave was available. The Court found his presence indispensable on both days and said employees need not exhaust internal procedures before lodging a statutory complaint.
