The Labour Court rejected Gerard Foy’s appeal against the dismissal of his complaint that the Health Service Executive penalised him after he reported a work colleague’s assault of a resident. The Court’s decision was signed on 18 July 2025.
The Court found Foy’s written report qualified as a protected disclosure, but said he had not established a causal link between it and the alleged workplace detriments. It affirmed the Adjudication Officer’s decision that the complaint was not well founded.
