The Workplace Relations Commission found Lucas Albau Hernandez’s penalisation complaint against Tiktok Technology Limited not well founded in a decision dated 29 July 2026. Hernandez alleged he was penalised after raising concerns that performance figures had been manipulated and used in performance management and redundancy selection. TikTok denied penalisation and said its decisions reflected performance and business considerations.

The adjudication officer treated two identical complaints as one and confined the decision to the Protected Disclosures Act. The officer found Hernandez’s concerns related exclusively to his own performance figures and grievance, with no evidence of broader wrongdoing affecting colleagues. Under section 5(5A), the officer concluded the matter was a personal grievance rather than a protected disclosure. No award was recorded.
