The Labour Court varied a Rights Commissioner's decision and ordered Car Park Security Limited (In Liquidation) to pay Pavel Cojocaru €2,271.36 in minimum-wage arrears. The determination was signed on 5 December 2014.
The Rights Commissioner had found that the company paid Cojocaru below the statutory minimum hourly rate from 1 January 2010 to 4 March 2012. Cojocaru appealed, seeking compensation for further underpayments from 5 March 2012 to 4 March 2013, when he was made redundant.
The company's liquidator did not attend the hearing or make submissions. The Court relied on Cojocaru's uncontested evidence, found the complaint well founded and ordered the company to pay the arrears due under the National Minimum Wage Act.
