The Labour Court varied an award to Katarzyna Saj Kozdryk, directing Tesco Ireland Limited to pay €7,263.20 after finding it had not returned her to her payroll job following maternity leave. The determination was dated 4 December 2020.
Saj Kozdryk, represented by Mandate Trade Union, had worked in payroll for three and a half years before taking leave. Tesco said her role was as a General Sales Assistant or Customer Assistant, with flexibility to work across store departments.
The Court found her payroll position was the capacity in which she had been employed before her leave and that Tesco breached the Maternity Protection Acts by not returning her to it. It made no direction about her return to work and varied the Adjudication Officer’s earlier €3,631.60 award, replacing it with €7,263.20 compensation.
