The Labour Court affirmed the decision that Tulane Business Management Limited had not breached Olga Barabola’s maternity return-to-work rights. The determination was signed on 28 November 2016, and Barabola’s appeal failed. Barabola said she had been offered a permanent Accounts Auditor role before her maternity leave and was entitled to return to it. The company said her substantive role was Night Auditor and the Accounts Assistant work was temporary. The Court accepted that her substantive role was Night Auditor and found that changing her title to Senior Receptionist did not change the nature of that role. It found the complaint was not well founded.
