The Labour Court refused to extend Paul Scales’s deadline to appeal a decision on complaints against his former employer, Euro Parks Ireland Limited. The determination was dated 5 December 2022. The appeal concerned several employment Acts; the adjudication officer had found the complaints not well founded. Scales cited Christmas, Covid restrictions, difficulty understanding the time limit and a physical disability that limited his travel. The Court found Christmas was not exceptional and that he had not given a credible reason why the pandemic prevented him from appealing within 42 days. It also noted that the WRC cover letter advised him of the deadline. The appeal was received outside the 42-day period, and the Court declined to extend it. The merits were not decided.
