The Labour Court overturned a €1,875 award to Sorcha McClenaghan after her former employer, Ticket Text Ltd T/A Ticket Abc, appealed the Adjudication Officer’s decision. The Court’s determination was dated 22 January 2021.
McClenaghan’s employment ended on 1 March 2019 after she had been placed on short time. She claimed and received a statutory redundancy payment. The Court said the law treated an employee who received such a payment for short-time work as having voluntarily left employment, even though it found she had not left voluntarily in the ordinary sense. It therefore determined she was not entitled to notice and set aside the original decision.
