The Labour Court overturned the decision rejecting Wieslaw Tyka’s minimum notice claim and ordered Mc Stone Systems Limited T/A Stone Systems to pay him €4,218. The determination was dated 20 December 2017. Tyka appealed after an adjudication officer found his claim was not well founded because he had been dismissed for gross misconduct. The company argued that gross misconduct meant it did not have to give him notice. In a related unfair dismissal appeal, the Court found Tyka had been unfairly dismissed. With more than 10 years of service, he was entitled to six weeks’ minimum notice at his weekly rate of €703.
