The Labour Court recommended that Glanbia PLC (Shared Services) make all existing temporary employees permanent and select two short-service and two long-service volunteers for redundancy. The recommendation was signed on 5 December 2008. Glanbia planned to cut five clerical jobs at its Shared Service Centre in Dungarvan. Unite opposed selection by last-in-first-out, arguing the redundancy agreement provided for voluntary redundancy based on seniority. Glanbia said a voluntary package for permanent staff could harm future employment and that staffing needed to remain flexible as work levels changed. The Court said its recommendation applied to this particular situation without setting a precedent. It also recommended immediate negotiations on a replacement redundancy agreement for the shared services division.
