The Labour Court recommended that Burlington Industries (Ireland) Ltd offer a dismissed worker re-employment for six months on probation. The recommendation, signed on 27 October 1986, followed a dispute with the Irish Transport and General Workers’ Union.
Burlington said the worker had repeatedly breached attendance requirements despite warnings and suspensions. The union argued that serious domestic difficulties had contributed to his absences and that he was ready to meet his work obligations.
The Court made its recommendation in what it called special circumstances. It noted that the worker had agreed to visit the company’s doctor and follow an appropriate course of treatment.
