The Labour Court allowed Acchl Limited T/A Homesavers’ appeal and set aside a €30,000 award to Darrell Donnelly, finding his complaint was not made out. The determination was signed on 26 February 2025. Donnelly alleged that Homesavers penalised him for raising concerns about a mouse infestation at its Limerick store, including by changing his work location and duties and releasing him from work with pay. The Court found he suffered no detriment for his earlier complaints, the paid release was not a suspension or disciplinary measure, and the proposed transfer never took place. It attributed the measures to his distress and repeated resignations, rather than his protected complaints.
