The Labour Court awarded teacher Cliona White €6,500 after finding that Dun Laoghaire VEC breached her fixed-term work rights. The determination was signed on 9 December 2013.
White appealed a Rights Commissioner decision that had declared her complaint out of time. The Labour Court found the appeal was properly before it and decided the complaint on its merits.
The VEC said White had been hired to cover for staff on leave, including a teacher on career break. The Court found that explanation did not account for White working 22 hours when the teacher she replaced had 18 class contact hours, or for classes on White’s timetable that were not on the other teacher’s timetable. It found the required justification had not been established.
