The Labour Court accepted that Ms Janice Thompson had reasonable cause for filing her discrimination complaint against Tesco Ireland 16 days late, and referred it for investigation and recommendation by an Equality Officer. The Court signed its decision on 13 August 1999. The complaint had been pursued with Tesco Ireland by Thompson’s union between June and November 1998. Her union representative told the Court he expected the matter to be resolved with the company and had not discussed it with Thompson until 9 February 1999. The Court said it was not entirely free from doubt, but found reasonable cause for the delay. The complaint’s merits were not decided.
