The Labour Court found Derby Transport Limited victimised Alexandru Sirbu by dismissing him after he attended a WRC hearing on statutory complaints and disclosed information about the company’s alleged pay practices. It set aside the earlier decision rejecting his complaint and awarded him €40,000 compensation.
The Court dated its determination 28 March 2025. Derby Transport Limited did not attend the appeal hearing. Sirbu said the dismissal followed his disclosures to the WRC; the Court found he had established facts supporting an inference of victimisation, which the company did not attend to rebut.
