Labour Court dismisses Rotunda Hospital equality appeal on jurisdiction

The Labour Court dismissed Ms Siobhan Mcnally's equality appeal against Rotunda Hospital on jurisdictional grounds and upheld the earlier decision declining to hear her complaint. The determination was dated 30 September 2024. The merits were not decided. The Hospital argued that the claim concerned alleged discrimination after McNally's employment had ended. The Court relied on earlier findings that her employment ended on 20 May 2019, while the WRC received her complaint on 3 October 2022. McNally objected that her ill-health dismissal was decided by someone who was not a medical professional and that the Hospital had not called a medical witness.
